Cabinet Approves 6% DA Hike for Central Govt Staff

In a bid to provide relief from high inflation, the government today increased dearness allowance (DA) by 6 per cent to 51 per cent, benefiting over 50 lakh central government employees and 38 lakh pensioners.
"The decision to hike DA was taken by the Union Cabinet at its meeting here," a Union minister said.
The combined impact of the hike will be Rs 5,715.90 crore per annum. However in the next financial year, the burden on the exchequer would be Rs 6,668.52 crore after the additional 6 per cent DA payout is factored in from January 1 to March 31 this year.
The increased DA, which will be effective from January 1, is provided to government staff and pensioners to compensate them for rising prices.
Presently, the DA is paid at 45 per cent of basic pay. The increase in DA by 6 per cent would be in accordance with the formula prescribed by the Sixth Pay Commission for central government employees.
The decision will provide direct relief to around 50 lakh employees and 38 lakh pensioners.
The DA is revised twice a year, on January 1 and July 1.
The relief came amid high retail prices, as inflation has been ruling above 9 per cent.
The Consumer Price Index (Industrial Workers), which is the basis for revising dearness allowance, was 9.47 per cent in December and 9.30 per cent in January.
Headline inflation, based on movement in wholesale prices, was 8.31 per cent in February, much above the comfort level of 5-6 per cent. Food inflation, too, was hovering above 9 per cent.

Professor Kehar Singh's letter to Secretary (Finance), Govt. of Punjab against Wrong Fixation of Pensions/Family Pension of University and College Teachers.

Sir/Madam,
This is in reference to your letter No. 3/39/09-3FPPC/1568 dated 30.12.10. In the Annexure-B of this letter the pension of the teachers is supposed to have been fixed as per the criteria notified in Para 4.2 by the Pb. Government letters No. 3/23/09 3FPPC/885 dated 17th August 2009 and 3/23/09 3FPPC/201 dated 22nd Feb. 2010. Para 4.2 of the letter dated 22nd February, 2010 was a clarification of the para with the same number in the earlier letter issued on 17th of August 2009. The relevant portion of Para 4.2 reads as under:
"the benefit of fixation of revised pension envisaged in para 4.2 of the aforesaid letter will be subject to the condition that full pension, in no case shall be less than 50% of the initial pay shown in column 8 of the schedule of the Punjab Civil Services (revised pay) rules 2009, against relevant Pay Band and Grade Pay corresponding to the pre-revised scale of pay in which the pensioner had last worked."
The 22nd February, 2010 letter was aimed at removing the confusion, if any, in making calculations for the fixation of pension of pre 01-01-2006 pensioners. But unfortunately, while fixing the pension of the University and College teachers Para 4.2 has not been followed.
The proper connotation of the term initial pay in the revised pay scales of the teachers as per Punjab Government Notification No. 10/3/09-3 edu.1/3321 dated 02.09.2009 has not been kept in view as has been done in the case of Punjab Government employees. This is a discrimination against the Punjabi University Teachers because the pension rules applicable to them are same as for other Punjab Government Employees (Pension Scheme Rule 10,P.95 Punjabi University Calendar Volume I). Initial Pay is not necessarily the sum total of Basic Pay in the Pay Band and Grade Pay. In certain grades it may be so whereas in some other grades it may be quite higher than this (Annexure A) of the Pb. Govt. letter No. 3/39/09-3fppc/201 dated 22nd February 2010). To illustrate as to how Annexure B dated 30-12-2010 discriminates against the teachers we may take the case of pension for grade 31 employees in Annexure A for Punjab Government pensioners and pension of a Professor as per the Annexure B.

From the above table discriminatory application of the term Initial Pay as per para 4.2 of the aforesaid Government Notification is evident.
In Annexure A there are 3 sub heads under the Revised Pay Structure w.e.f. 1.1.2006 viz. Pay Bands, Grade Pay and Initial Pay where as in Annexure B only 2 sub heads that is Pay Bands and Grade Pay has been taken into consideration and the crucial sub head of Initial Pay has not been kept in view. This seems to have been done on the presumption that Initial Pay is equal to sum total of the Initial of the Pay Band and Grade Pay. As is evident from Annexure A this is not the case.
Till January 2011 Panjab University, Chandigarh and Punjabi University, Patiala have been rightly admitting pensions to their teachers in the light of the para 4.2 as per the table given below:

Following your letter dated 30.12.2010 now they have lowered the pensionary benefits to the level of teachers working in Central Universities and Colleges. This is violative of para 4.2 applicable to the College and University teachers in the State of Punjab. Your letter of 30.12.2010 clearly states that "the benefit of revised pension/family pension envisaged in para 4.2 of the aforesaid letters (i.e. 17.8.2009 and 22.2.2010) will be available for fixation of pensioner/family pensioner of teachers and equivalent cadres in government colleges in the State". Our contention is that the figures in the table fixing the pension have not been rightly worked out. This is a computing mistake which can be rectified by taking basic pay (initial pay) of the teachers shown in tables 1 to 5 of Punjab Government notification No. 10/3/2009-Edu.1/3321 dated 2.9.2009 as has been done in the case of pre 1.1.2006 pensioners of Punjab Government. Our main point is that if the same policy decision is applicable to the Punjab Government pensions and the teachers working in the Colleges and Universities of the State how come the teachers with higher basic pay in the pre-revised scales as well as the revised scales are entitled for lower pension as compared to the nearest scales of pay shown in Annexure-A fixing the pension for Punjab Government employees retiring before 1.1.2006.
In view of the above, it is requested that Annexure B of the letter No. 3/39/09-3 FPPC/1568 dated 30.12.10 be suitably amended in the light of the correct connotation of the term Initial Pay in Para 4.2.

Subject: WRONG, INCONSISTENT & DISCRIMINATORY FIXATION OF PENSION OF PRE-2006 RETIRED PROFESSORS VIDE Punjab Government, Department of Finance Letter No.3/39/09-3FPPC/1568 Dated 30/12/2010 on the subject of Implementation of the Recommendations of the Fifth Punjab Pay Commission -- Revision of Pension of pre 01-01-2006 Pensioners/Family Pensioners/Recipients of Extraordinary Pension etc.

I would like to bring to your notice the injustice done to Pre-2006 Retired Professor Pensioners vide letter No.3/39/09-3FPPC/ 1568 dated 30-12-2010, issued as a sequel to letter No.3/39/09-3FPPC/201 dated 22-2-2010, wherein para 4.2 of letter No. 3/23/09-3FPPC/885 dated 17-8-2009 was partially modified.
As far as Pre-2006 Retired Professor Pensioners are concerned, the net effect of this partial modification of para 4.2 is nil because of the illogical, inconsistent and discriminatory application of the said para as shall become evident presently. A cursory look at the letter of 30-12-2010 brings out that it has been an exercise in futility, since status quo ante 22-02-2010 is not altered at all to the benefit of the Pre-2006 Retired Professor Pensioners unlike for other Pre-2006 Government Pensioners. Put in other words, the application of para 4.2 of letter of 17-08-2009 in letter of 30-12-2010, instead of the modified para 4.2 of letter of 22-02-2010, has worked to the detriment of the Pre-2006 Retired Professor Pensioners when compared with the other 32 categories of Pre-2006 GoP Pensioners.
2. What is NOT obvious is that the Pre-2006 Retired Professor Pensioners stand DOWNGRADED both in relation to their pre-revised scales as also grade pay in the revised pay bands, as is evident in the following Table.
NOTE: The pension of Pre-2006 Retired Professor Pensioners, taken from Annexure B of 30-12-2010 letter, is interpolated with that of Pensioners at Serial Nos. 31 & 32 taken from Annexure A of 22-02-2010 letter, to bring out the disparity.

I may add that this inter se chaos did not exist under the letter of 17-08-2009.
3. Now, para 4.2 as given in Punjab Government Finance Department letter No. 3/23/09-3FPPC/885 dated 17-8-2009 reads as follows:
4.2 The fixation of pension will be subject to the provision that the revised pension, in no case, shall be lower than fifty percent of the minimum of the pay in the pay band plus grade pay corresponding to the pre-revised pay scale from which the pensioner had retired. This will be reduced pro-rata if the qualifying service of the person falls short of 33 years.
Since the fixation of one’s pension depends on the minimum of the pay in the pay band plus grade pay corresponding to the pre-revised pay scale from which the pensioner had retired, the entitlement of Pre-2006 Retired Professor Pensioners under this para is given in the Table below and this is what precisely they had already been drawing before the issue of 30-12-2010 letter:

4. In the letter of 22-02-2010, the partially modified para 4.2 reads as follows:

THE INITIAL PAY, AS GIVEN IN THE ABOVE SCHEDULE/GENERAL CONVERSION TABLE, IS EQUAL TO THE REVISED BASIC PAY [TOTAL OF PAY IN THE PAY BAND AND GRADE PAY] IN THE REVISED PAY SCALE CORRESPONDING TO THE BASIC PAY AT THE FIRST STAGE OF THE PRE-REVISED PAY SCALE TO WHICH AN INCUMBENT IS ENTITLED ON 01-01-2006. THIS IS EVIDENT FROM FITMENT TABLES No.1 TO No.32 ANNEXED TO THE SAID PUNJAB GOVERNMENT DEPARTMENT OF FINANCE) NOTIFICATION No.5/10/09-5FPI/207 DATED THE 27th May, 2009.
To illustrate the point, I am giving below only Fitment Table No. 32 from the Notification No.5/10/09-5FPI/207 of 27th May, 2009 from which the above Schedule has been taken.

Quite clearly, the initial pay shown in column 8 of the Schedule against Serial No. 32 [Rs 54700] is the Revised Basic Pay [Rs 54700] in the Pay in the Pay Band plus Grade Pay, shown in column 4 corresponding to the first stage of Basic Pay in the Pre-revised Scale [Rs 18600].
To prepare a General Conversion Table for Pre-2006 Government College pensioners [teachers & equivalent] on the pattern of the Schedule, we need to refer to Annexure-I and Annexure-II of Punjab Government Department of Higher Education (Education Department) NOTIFICATION No.10/3/09-3Edu.1/3321 2-9-2009. Annexure-I gives Fitment Tables and Annexure-II para 2 gives details of new pay structure of various categories of teachers. The pay structure for different categories of teachers and equivalent positions is as indicated below:-
(a) Assistant Professor/Associate Professors/Professors in Colleges & Universities
(i) Persons entering the teaching profession in Universities and Colleges shall be designated as Assistant Professors and shall be placed in the Pay Band of Rs. 15600-39100 with AGP of Rs. 6000. Lecturers already in service in the pre-revised scale of Rs. 8000-13500, shall be re-designated as Assistant Professors with the said AGP of Rs. 6000.
(vi) The pay of the incumbents to the posts of Lecturer (senior scale) (i.e. the un-revised scale of Rs. 10,000-15200) shall be re-designated as Assistant Professor, and shall be fixed at the appropriate stage in Pay Band of Rs. 15600-39100 based on their present pay, with AGP of Rs. 7000.
(viii) Posts of Associate Professor shall be in the Pay Band of Rs. 37400-67000, with AGP of Rs. 9000. Directly recruited Associate Professors shall be placed in the Pay Band of Rs. 37400-67000 with an AGP of Rs. 9000, at the appropriate stage in the Pay Band in terms of the conditions of appointment.
(ix) Incumbent Readers and Lecturers (Selection Grade) who have completed 3 years in the current pay scale of Rs. 12000-18300 on 1.1.2006 shall be placed in Pay Band of Rs. 37400-67000 with AGP Pay of Rs. 9000 and shall be re-designated as Associate Professor.
(x) Incumbent Readers and Lecturers (Selection Grade) who had not completed three years in the pay scale of Rs. 12000-18300 on 1.1.2006 shall be placed at the appropriate stage in the Pay Band of Rs. 15600-39100 with AGP of Rs. 8000 till they complete 3 years of service in the grade of Lecturer (Selection Grade)/Reader, and thereafter shall be placed in the higher Pay Band of Rs.37400-67000 and accordingly re-designated as Associate Professor.
(xiii) . . . The Pay Band for the post of Professors shall be Rs. 37400-67000 with AGP of Rs. 10000.
Using this information, we can prepare a schedule-like schema in the form of the following Table to work out the initial pay of the five categories of teachers & equivalent:

Note 1:- As per para 4.2 of Punjab Government letter No. 3/23/09-3FPPC/885 dated 17th August 2009 as modified vide letter no. No.3/39/09-3FPPC/201 Dated 22nd February, 2010, the revised pension of those pensioners who retired after completing maximum qualifying service (i.e. 33 years) before 1.1.2006 cannot be less than the pension indicated in the column 6 above (50% of the Initial Pay mentioned in column 5 above against relevant Pay Band and Grade Pay corresponding to the pre-revised scale of pay held by the pensioner s at the time of their retirement). The pension in column 6 will be reduced pro-rata, where the pensioner had less than the maximum required qualifying service (i.e. 33 years) for full pension as applicable on 1.1.2006 and in no case it will be less than Rs 3500/- p.m. In case the pension consolidated as per para 4.1 of Punjab Government letter No. 3/23/09-3FPPC/885 dated 17th August 2009 is higher than the pension calculated in the manner above, the same (the higher pension) will be treated as Basic Pension.
6. The pension of Pre-2006 Government College pensioners [teachers & equivalent], which should also have been worked out using the same principles as used for the above Annexure-A, is given in the following Table.

Instead of following consistently the modified para 4.2 given in the letter of 22-02-2010 and the concept of initial pay as given in column 8 of the Schedule (Notification dated 27-05-2009] for Pre-2006 Government College pensioners [teachers & equivalent] as explained above, the Government issued the following patently wrong, inconsistent, and discriminatory Annexure-B in its letter of 30-12-2010:

Revised Pension/Family Pension based on Pay Band, grade Pay and Initial Pay of teachers and equivalent cadres in colleges in the State with effect from 1st January, 2006, corresponding to the pre-revised pay scales.
(Refer to Punjab Government Notification No. 10/03/09-3Edu.1/3321 dated 2.9.009 and para 4.2 of Punjab Government letter No. 3/23/09-3FPPC/8885, dated 17th August,2009 and letter No. 3/23/09- 3FPPC/201, dated 22nd February, 2010).

Note: The pension shown in column 6 is for maximum qualifying service of 33 years. In cases of pensioners, where qualifying service is less than 33 years, the pension shown shall be reduced pro-rata.
In this Annexure, even though lip service is paid to the initial pay, and reference made to letter No. 3/23/09-3FPPC/201, dated 22nd February, 2010, the initial pay as given in column 8 of the Schedule has been replaced by the minimum of the Band Pay to the detriment of Pre-2006 Government College Pensioners [teachers & equivalent].
8. It is, therefore, requested that this discrimination be done away with as soon as possible by defining the Initial Pay in the same way as it is for other Pre-2006 Punjab Government Pensioners, and a fresh Annexure similar to the following issued to ensure and assure the Pre-2006 Government College pensioners [teachers & equivalent] that a different and discriminatory yard stick is not applied to them.

9. The Pre-2006 Government College retired pensioners [teachers & equivalent] simply want to be treated like the other 32 categories of pre 2006 government pensioners BECAUSE THEY ARE COVERED BY THE SAME PUNJAB GOVERNMENT PENSION RULES AS ARE OTHER GOVERNMENT PENSIONERS like it has ALWAYS been the case when pay scales have been revised in 1996, 1986, and 1973.
